Here, distinguished Italian philosopher Giorgio Agamben uses such circumstances to argue that this unusual extension of power, or "state of exception," has historically been an underexamined and powerful strategy that has the potential to transform democracies into totalitarian states.
The sequel to Agamben's "Homo Sacer: Sovereign Power and Bare Life, State of Exception" is the first book to theorize the state of exception in historical and philosophical context. In Agamben's view, the majority of legal scholars and policymakers in Europe as well as the United States have wrongly rejected the necessity of such a theory, claiming instead that the state of exception is a pragmatic question. Agamben argues here that the state of exception, which was meant to be a provisional measure, became in the course of the twentieth century a normal paradigm of government. Writing nothing less than the history of the state of exception in its various national contexts throughout Western Europe and the United States, Agamben uses the work of Carl Schmitt as a foil for his reflections as well as that of Derrida, Benjamin, and Arendt.
In this highly topical book, Agamben ultimately arrives at original ideas about the future of democracy and casts a new light on the hidden relationship that ties law to violence.

吉奥乔·阿甘本,1942年出生于罗马,当代最具影响力的欧陆思想家之一,其思想承继海德格尔与本雅明,研究涵盖哲学、语言学、美学、政治与神学。代表作为《神圣之人:主权力量与赤裸生命》(1995),追溯当代主权与生命政治结构的哲学—历史系谱。晚近的重要作品则有《王国与荣光:一个对于经济与治理的神学系谱学考察》以及《至贫:修道院规约与生活形式》。
薛熙平,台湾交通大学社会与文化研究所博士生。曾以《例外状态:阿冈本思想中的法与生命》为题完成硕士论文目前研究领域为精神医疗人类学。合译有朗西埃的《歧义》。

对阿甘本来说,例外状态之所以构成西方司法-政治机器(bare life是其产品)的邪恶轴心,在于其通过对一个悬而未决之界槛状态的激活,成功将anomie and nomos, life and law, auctoritas and potestas联结起来;而对这种联结的拆解就意味着为"the only truly political action”开启生机。虽然还是没太明白如何破局,但阿氏对本... 对阿甘本来说,例外状态之所以构成西方司法-政治机器(bare life是其产品)的邪恶轴心,在于其通过对一个悬而未决之界槛状态的激活,成功将anomie and nomos, life and law, auctoritas and potestas联结起来;而对这种联结的拆解就意味着为"the only truly political action”开启生机。虽然还是没太明白如何破局,但阿氏对本雅明与施米特之间那场巨人之战(“battle of giants")的追踪实在是太激动人心了,呼唤一种pure violence! 所谓genealogy就是资料集嘛。每一章结论和现象跳跃这么大,而且几乎是用一样的zone of indistinction来解释一切。最奇葩的就是解释本雅明与Schmitt了,把derrida, linguistics, Weber, marx之类的结论来援证自己的猜测,换几个词来阐述自己的理论,所以说这本书好看的只有大部分通过etymology来看concept发展的最后一部分,本雅明是扔进来... 所谓genealogy就是资料集嘛。每一章结论和现象跳跃这么大,而且几乎是用一样的zone of indistinction来解释一切。最奇葩的就是解释本雅明与Schmitt了,把derrida, linguistics, Weber, marx之类的结论来援证自己的猜测,换几个词来阐述自己的理论,所以说这本书好看的只有大部分通过etymology来看concept发展的最后一部分,本雅明是扔进来和稀泥的吧 (展开)

比前一本书写的更谨慎也更紧凑,读起来不那么福柯了。阿甘本的立场当然是更偏向本雅明的,因此他们对于暴力的批判立足于政治,但指向的是eschatology,故而pure violence与其说是sovereign violence,不如说是divine violene,而这一点上则是与施密特划清了界限。正如经院哲学作家喜爱在他们的讨论中使用paradox,阿甘本也指出政治体系的悖论在于法律的运行本质上... 比前一本书写的更谨慎也更紧凑,读起来不那么福柯了。阿甘本的立场当然是更偏向本雅明的,因此他们对于暴力的批判立足于政治,但指向的是eschatology,故而pure violence与其说是sovereign violence,不如说是divine violene,而这一点上则是与施密特划清了界限。正如经院哲学作家喜爱在他们的讨论中使用paradox,阿甘本也指出政治体系的悖论在于法律的运行本质上依托于它的不在场,故有本雅明指出的the empty cycle of law-constituting and law-breaking violence,而state of exception则是这两种状态的模糊边缘。施密特和本雅明的论辩是中轴,而最后一章则内含对20世纪世界历史的反思批判。 (展开)
